(a) LOLER replaced existing legal requirements relating to the use of lifting equipment.

The regulations require you to do the following

(b) Before lifting equipment is used for the first time it must be examined by a competent person and thereafter at regular intervals.

(c) Where equipment is used for lifting people it must be suitably marked and safe for the purpose.

(d) The lifting operations must be carried out by competent people in a safe manner.

Competent Person

This person must have the appropriate practical and theoretical knowledge and experience of the lifting equipment to be examined, to enable them to detect actual or potential defects or weaknesses and to assess their importance to its installation and operation, i.e. a person who has been trained by the manufacturer or manufacturer’s agent. It is important that the person is impartial and independent to allow objective decisions.

If you use your own person you must ensure their total impartiality to carry out the examinations "without fear or favour".

Examination Intervals

Lifts used for lifting people must be examined every six months or at intervals decided by drawing up your own scheme and ensuring that you comply.

Other criteria requiring a thorough examination

(1) A new installation before going into service (Installation & Weight Test Certificate).

(2) Re-installation on a different vehicle.

(3) Following an accident or dangerous occurrence.

(4) Any significant changes in conditions of use.

(5) After long periods out of use.

(6) Any circumstances which effect the safe use of the lift.

Persons responsible for the above are the operators of the lift or who have control in the workplace for the safe use of lifting equipment.
